RICHARD LOMBARDO

Mr. Lombardo’s practice has included representing both individuals and companies in litigation including business litigation, construction litigation, mass torts, products liability, medical malpractice, and personal injury. He has represented institutional clients in substantial complex matters including, among others, lawsuits against “big four” accounting firms and international investment banking firms. From 2001 to 2012, he was co-lead counsel for the Honorable Albert Riederer, Special Deputy Receiver for General American Mutual Holding Company (parent of General American Life) and its 325,000 policy holders. During that time, Mr. Lombardo and his team were successful in recovering over $250 million on behalf of the Receivership and the policy holders of General American, including settlements of $95 million and $100 million against international investment banks. Mr. Lombardo has also been appointed as class counsel in national consumer class actions and national antitrust class actions.

In Mr. Shurin’s general trial and business practice, he has litigated and negotiated on behalf of small businesses, Fortune 500 companies and individuals in regards to mergers, acquisitions, leasing, contracts, franchising and employment related matters. What is the deadline to submit a claim?

The deadline is February 4, 2025.  After this date, no more applications will be accepted.

What documentation do I need to provide with my claim?

Complete the fields on this form.  Upon our review we will inform you if there is any additional documentation required.

What if I sold my business?

Even if you sold your business, if you accepted credit cards as a form of payment from 2004 -2019, you can still submit the claim and be included to receive settlement funds.

Are there any fees associated with submitting a claim?

There are no upfront fees for submitting your claim.  The law firm will take a percentage of the settlement amount as payment for representing you, performing the research, filling out and filing all of the legal forms, and fighting for the maximum amount owed to you for this claim.  The law firm is incentivized, on your behalf, to do everything possible to help maximize your compensation.

Who is eligible to participate in the settlement?

Businesses that accepted Visa and/or Mastercard credit or debit cards in the United States between January 1, 2004, and January 25, 2019, may be eligible to participate in the settlement.

How much can I expect to receive from the settlement?

The amount paid from the settlement fund will be based on your actual or estimated interchange fees attributable to Visa and Mastercard card transactions (between you and your customers) from January 1, 2004, through January 25, 2019.

The amount of money each Authorized Claimant will receive from the settlement fund depends on the money available to pay all claims, the total dollar value of all valid claims filed, the cost of class administration and notice, applicable taxes on the settlement fund and any other related tax expenses, attorneys’ fees and expenses, and money awards to the Rule 23(b)(3) Class Plaintiffs for their representation of merchants in MDL 1720, which culminated in the Class Settlement Agreement, all as approved by the Court.

When will I get paid?

No payments are expected to be made until after the end of the Claims Period on August 30, 2024. Because the pro rata cannot be determined until all Claims are filed and reviewed and until the Court approves the final amounts, we do not yet know when payments will be made. 

How do I submit a claim for the settlement?

You can fill out our form that you received from your associate to begin the process.  After you fill out this form, you will be presented with an Engagement Agreement, which gives our law firm authority and permission to submit this claim on your behalf.  This Engagement Agreement also states all the terms, fees, and other parameters for this engagement.  You can also contact the person who contacted you regarding this settlement for assistance.

Class members need not sign up for a third-party service to participate in any monetary relief and no-cost assistance will be provided from the Class Administrator and Class Counsel during the claims-filing period. For further information, please visit paymentcardsettlement.com

Can I still accept Visa and Mastercard at my business if I participate in the settlement?

Yes, participating in the settlement does not affect your ability to accept Visa and Mastercard at your business. The settlement is a resolution of past alleged overcharges and does not impact future transactions.

Once I have filed what happens next?

Once your claim is submitted, it will be reviewed by the Class Administrator. You will be contacted if additional information is needed from you, or if there are any issues regarding your claim.  Accurate processing of claims may take some time. The legal counsel will work diligently to resolve any issues and expedite your claim acceptance.

Once your claim is accepted, the Class Administrator will indicate how much you were charged for interchange fees during this period.  The legal counsel will then prepare and submit your claim based on the amount you paid in interchange fees.  The amount you will receive will be different than this qualified amount.  Because the pro rata cannot be determined until all Claims are filed and reviewed and until the Court approves the final amounts, we do not yet know the exact amount each business will receive. 

Why is your name 46-59 Law?

Our law firms before we combined were located on 46th street and 59th street.  When we became partners, we thought this was fitting for our new firm as a combination of two great firms.
